1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Scale For Grams ("we," "us," or "our") governing your access to and use of the Scale For Grams mobile application ("App"), including all features, content, functionality, and services offered through the App.

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately uninstall the App and discontinue all use.

You represent and warrant that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

We reserve the right to modify, update, or revise these Terms at any time. Your continued use of the App after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Description of Service

Scale For Grams is an AI-powered mobile application that provides a suite of estimation, identification, and analysis tools. The App offers the following features:

Weight Estimation: AI-driven visual analysis to estimate the weight of objects captured by your device's camera.
Measurement Estimation: Approximate dimensional measurements (length, width, height) of objects using image analysis.
Object Identification: Recognition and classification of objects in photographs using artificial intelligence.
Plant Identification: Identification and information about plant species from photographs.
Calorie Counting: Nutritional estimation of food items based on visual recognition.
Translation: Text and visual translation capabilities powered by AI.
Coin & Currency Identification: Recognition and information about coins and currency from photographs.
Color Palette Extraction: Identification and extraction of color palettes from images.

The App utilizes Google Gemini AI technology to process images and provide results. All features are designed to deliver informational estimates and should be understood within the limitations described in these Terms.

3. AI Estimation Disclaimer

IMPORTANT — PLEASE READ CAREFULLY: All results, measurements, identifications, and outputs provided by Scale For Grams are estimates only. The App relies on artificial intelligence and machine learning algorithms to analyze visual data, and such technology is inherently imperfect and subject to error.

You expressly acknowledge and agree that:

The App does not contain a physical scale, sensor, or scientifically calibrated measurement instrument of any kind.
Weight estimations are generated entirely through AI-based visual analysis and are approximate in nature. They may vary significantly from actual weights.
Measurement estimations (dimensions, sizes) are similarly approximate and should not be relied upon for precision.
Object, plant, coin, and currency identifications may be inaccurate, incomplete, or incorrect. Results should be independently verified.
Calorie and nutritional estimates are approximations and may differ substantially from actual nutritional values. They are not a substitute for professional dietary or nutritional advice.
Translation results are AI-generated and may contain errors, inaccuracies, or contextual misinterpretations.
Results can be influenced by numerous factors including lighting conditions, camera angle, image quality, object orientation, background clutter, and other environmental variables.
AI models are continuously evolving and results may vary between sessions, even for the same object under similar conditions.

Scale For Grams is an estimation tool designed for casual, informational, and entertainment purposes. It is not a certified or calibrated measuring instrument.

4. Accuracy Limitations

While we strive to improve the accuracy and reliability of our AI models, we make no guarantees, warranties, or representations regarding the accuracy, precision, completeness, reliability, or suitability of any results provided by the App. Specific limitations include but are not limited to:

Weight Estimates: Accuracy depends on object visibility, reference context, and AI model interpretation. Estimates may deviate significantly from actual weight values.
Plant Identification: Misidentification of plants — including potentially toxic, allergenic, or poisonous species — is possible. Never consume, touch, or interact with a plant based solely on the App's identification. Always consult a qualified botanist or authoritative resource.
Calorie Estimates: Nutritional values are rough approximations. Portion sizes, preparation methods, hidden ingredients, and food composition can cause substantial variance from actual nutritional content.
Coin & Currency Identification: The App may misidentify denominations, values, or origins of coins and currency. Do not rely on the App for financial valuation or authentication.
Translation: Translations may contain grammatical errors, miss cultural nuances, or produce incorrect meanings. Critical translations should be reviewed by a qualified human translator.

You assume all risk associated with acting upon or relying on any results provided by the App.

5. Prohibited Uses

You agree that you will NOT use the App or any results generated by the App for the following purposes:

Medical Purposes: Do not use weight estimates, calorie counts, or any other outputs for medical diagnosis, treatment decisions, dietary planning for medical conditions, eating disorder management, pharmaceutical dosing, infant/child growth monitoring, or any health-related purpose where accuracy is critical.
Legal Purposes: Do not use results as evidence in legal proceedings, contractual disputes, regulatory compliance, law enforcement activities, or any legal matter.
Commercial Trade: Do not use weight estimates for buying, selling, pricing, or trading goods where accurate weight is material to the transaction, including but not limited to precious metals, gemstones, food products sold by weight, postal/shipping weights, or commodity trading.
Safety-Critical Applications: Do not use measurements or identifications in any context where inaccuracy could result in personal injury, death, property damage, or environmental harm. This includes but is not limited to structural engineering, aviation, vehicle loading, industrial manufacturing, chemical handling, or hazardous material management.
Scientific or Laboratory Purposes: Do not use results for scientific research, laboratory measurements, academic studies, or any application requiring certified or traceable measurements.
Financial Valuation: Do not use coin, currency, or object identification for authentication, appraisal, or financial valuation of items.
Food Safety: Do not rely on plant identification to determine whether a plant or mushroom is safe for consumption. Misidentification can lead to serious illness or death.

Any use of the App for the purposes listed above is at your own risk and sole responsibility. We expressly disclaim all liability arising from prohibited uses.

6. Subscription Terms

Scale For Grams offers both free limited access and premium subscription plans that unlock the full suite of features. The following subscription options are available:

6.1 Subscription Plans

Weekly Subscription: Starts with a 3-day free trial, then $4.99 per week (USD). The subscription automatically renews each week after the trial period ends unless canceled.
Lifetime Access: A one-time purchase of $39.99 (USD) that grants permanent access to all premium features with no recurring charges.

Prices are in United States Dollars (USD) and may vary by region based on Apple's pricing tiers and applicable exchange rates. Prices are subject to change, though any changes will not affect active subscription periods.

6.2 Free Trial

The weekly subscription includes a 3-day free trial period. During the free trial, you have full access to premium features at no charge. If you do not cancel the subscription before the free trial expires, your Apple ID account will be automatically charged the weekly subscription fee of $4.99. The free trial is available only once per Apple ID account. If you have previously redeemed a free trial for Scale For Grams, you will be charged immediately upon subscribing.

6.3 Payment & Billing

All payments are processed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase (or at the end of the free trial period, if applicable).
We do not collect, process, or store any payment or financial information. All billing is managed entirely by Apple.
You are responsible for any applicable taxes, fees, or charges imposed by your jurisdiction or payment provider.

7. Auto-Renewal & Cancellation

7.1 Auto-Renewal

Your weekly subscription will automatically renew at the end of each subscription period (every 7 days) unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of $4.99/week.

The lifetime access plan does not auto-renew, as it is a one-time purchase.

7.2 How to Cancel

You may cancel your subscription at any time through your Apple ID account settings. To cancel:

Open the Settings app on your iPhone or iPad.
Tap your name at the top of the screen.
Tap Subscriptions.
Select Scale For Grams from the list of active subscriptions.
Tap Cancel Subscription and confirm.

Alternatively, you can manage subscriptions through the App Store app or at https://apps.apple.com/account/subscriptions.

Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of the period you have already paid for. No partial refunds are provided for unused portions of a subscription period.

7.3 Free Trial Cancellation

To avoid being charged after a free trial, you must cancel your subscription at least 24 hours before the trial period ends. If you cancel during the free trial, you may lose access to premium features immediately, depending on Apple's policies. Any unused portion of the free trial period will be forfeited when you purchase a subscription.

8. Refund Policy

All purchases and subscriptions are processed through Apple's App Store and are subject to Apple's refund policies. We do not have the ability to issue refunds directly.

Apple determines refund eligibility at its sole discretion based on its own policies and applicable consumer protection laws. We encourage you to take advantage of the free trial period to evaluate the App before committing to a paid subscription.

9. Intellectual Property

9.1 Our Intellectual Property

The App, including but not limited to its design, layout, user interface, graphics, icons, text, code, software, algorithms, trademarks, trade names, logos, and all other content and materials (collectively, "App Content"), is the exclusive property of Scale For Grams or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property and proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not grant you any right, title, or interest in the App Content beyond what is expressly stated herein.

9.2 Restrictions

You agree not to:

Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App or any App Content.
Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the App.
Use the App or App Content for commercial purposes without prior written consent.
Distribute, sublicense, lease, rent, sell, or otherwise transfer the App or your rights under these Terms to any third party.
Use automated systems, bots, scrapers, or similar tools to access the App or extract data from the App.
Attempt to interfere with, disrupt, or compromise the integrity, security, or performance of the App or its underlying infrastructure.

10. User Content & Camera Usage

10.1 Camera Access

The App requires access to your device's camera to capture images for analysis. By granting camera access, you acknowledge that:

Images are captured solely for the purpose of providing the App's estimation, identification, and analysis features.
You are responsible for ensuring you have the right to photograph any object, person, location, or material you capture using the App.
You will not use the App's camera feature to photograph individuals without their consent, or in any manner that violates applicable privacy laws, regulations, or third-party rights.

10.2 Photo Library Access

The App may request access to your photo library to allow you to select existing images for analysis. Granting photo library access is optional and subject to the same responsibilities described above.

10.3 Image Processing

Images submitted for analysis are processed using Google Gemini AI. Please refer to our Privacy Policy for detailed information about how your images and data are handled, stored, and processed. By using the App, you consent to the processing of your images as described in our Privacy Policy.

10.4 User Responsibility

You are solely responsible for all content you capture, submit, or generate using the App. You agree not to use the App to capture, analyze, or process:

Content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Content that infringes upon the intellectual property rights, privacy rights, or other rights of any third party.
Content involving minors without appropriate parental or guardian consent.
Sensitive personal information of other individuals without their explicit consent.

11. Third-Party Services

The App integrates with and relies upon third-party services, including but not limited to:

Google Gemini AI: Used for image analysis, object recognition, weight estimation, and other AI-powered features. Your use of these features is subject to Google's terms of service and privacy policies.
Apple App Store: Used for app distribution, payment processing, and subscription management. Your use of the App Store is governed by Apple's terms and conditions.

We are not responsible for the availability, accuracy, content, or policies of any third-party services. Third-party services may have their own terms of service and privacy policies that you should review independently. Any interactions you have with third-party services are solely between you and the applicable third party.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND TITLE.

IN NO EVENT SHALL SCALE FOR GRAMS, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, exemplary, or punitive damages;
Loss of profits, revenue, data, goodwill, or business opportunities;
Personal injury, property damage, or any other damages arising from your use of or inability to use the App;
Damages arising from inaccurate weight estimates, measurements, identifications, calorie counts, translations, or any other output of the App;
Damages resulting from reliance on any information or results provided by the App;
Damages arising from unauthorized access to or alteration of your transmissions or data;
Damages arising from the actions or omissions of any third-party services;

regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

13. Disclaimer of Warranties

Without limiting the foregoing, we specifically disclaim any warranty that:

The App will meet your requirements or expectations;
The App will be uninterrupted, timely, secure, or error-free;
The results obtained from the use of the App will be accurate, reliable, or complete;
Any errors or defects in the App will be corrected;
The App is free of viruses, malware, or other harmful components;
The App will be compatible with all devices, operating systems, or configurations.

You acknowledge that the App uses AI technology that is inherently probabilistic in nature and that no AI system can guarantee perfect accuracy. Any reliance you place on the App's results is strictly at your own risk.

14. Indemnification

You agree to defend, indemnify, and hold harmless Scale For Grams, its owners, officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to reasonable attorneys' fees) arising from or related to:

Your use of or access to the App;
Your violation of these Terms;
Your violation of any applicable law, rule, or regulation;
Your violation of any third-party rights, including intellectual property, privacy, or publicity rights;
Any content you submit, capture, or generate through the App;
Any reliance you place on the App's results, estimates, identifications, or outputs;
Any claim by a third party that arose from your use of the App or its results.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

15. Termination

15.1 Termination by You

You may terminate your agreement to these Terms at any time by uninstalling the App and ceasing all use. If you have an active subscription, you must also cancel it through your Apple ID account settings to avoid further charges.

15.2 Termination by Us

We reserve the right to suspend, restrict, or terminate your access to the App at any time, with or without cause and with or without notice, including but not limited to situations where:

You breach or violate any provision of these Terms;
Your use of the App poses a security risk or may cause harm to other users, third parties, or our infrastructure;
Your use of the App is or may be in violation of applicable laws or regulations;
We are required to do so by law, regulation, or legal process;
We discontinue the App or any of its features or services.

15.3 Effect of Termination

Upon termination, your right to use the App immediately ceases. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law.

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

16.2 Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through good-faith informal negotiation. You agree to contact us at adk0110112@gmail.com before initiating any formal proceedings, and to allow at least thirty (30) days for resolution.

If the dispute cannot be resolved through informal negotiation, you agree that it shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA) or a mutually agreed-upon alternative dispute resolution provider. The arbitration shall take place in the State of California, United States.

16.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

17. Apple-Specific Terms

The following additional terms apply to your use of the App as downloaded from the Apple App Store:

These Terms are between you and Scale For Grams only, and not with Apple Inc. ("Apple"). Scale For Grams, not Apple, is solely responsible for the App and its content.
Your use of the App must comply with the Apple App Store Terms of Service.
Apple has no obligation to furnish any maintenance or support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Scale For Grams, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scale For Grams regarding your use of the App, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

18.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

18.3 Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Scale For Grams.

18.4 Assignment

You may not assign, delegate, or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may freely assign these Terms without restriction. Any purported assignment in violation of this section shall be null and void.

18.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, power outages, internet failures, pandemics, acts of terrorism, or disruptions to third-party services.

18.6 Notices

Any notices or communications under these Terms may be provided via the App, email, or other electronic means. Notices to us should be sent to the contact information provided below.

19. Changes to Terms

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide notice through one or more of the following methods:

Posting the updated Terms within the App;
Updating the "Last updated" date at the top of this page;
Sending a notification through the App;
Other reasonable means of communication.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the App and uninstall it from your device.

We recommend reviewing these Terms periodically for any updates or changes.
